Terms of Service

Welcome to Punch! These Terms of Service ("Terms") govern your access to and use of the Punch mobile application and related services (collectively, the "Service"), provided and operated by Remedy Apps LLC ("Company," "we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Eligibility & Age Restrictions

You must be at least 13 years of age (or the legal age of majority in your jurisdiction) to use the Service. By accessing or using Punch, you represent and warrant that you meet this age requirement. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. User Accounts & Authentication

To access the Service, you must create an account using third-party Single Sign-On ("SSO") providers, specifically Apple Sign-In or Google Sign-In.

You are responsible for maintaining the confidentiality and security of your SSO credentials. You agree that Remedy Apps LLC is not liable for any unauthorized access to your account resulting from compromised third-party authentication credentials.

3. Subscriptions, Paid Tiers & In-App Purchases

A. Subscription Tiers & Billing

Punch offers free access with limited block capacity, alongside optional paid auto-renewable subscription tiers ("POW!" and "WHAM!") that unlock additional block capacities and features:

• POW! Tier: Billed on a monthly ($3.99/month) or annual ($29.99/year) recurring basis.
• WHAM! Tier: Billed on a monthly ($7.99/month) or annual ($59.99/year) recurring basis.

Payment will be charged to your Apple ID Account or Google Play Account at confirmation of purchase.

B. Auto-Renewal & Cancellation

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. You can manage or turn off auto-renewal in your Apple ID or Google Play Account Settings at any time after purchase.

C. Refunds

All purchases, billing, and refund requests are processed directly through the Apple App Store or Google Play Store and are subject to their respective terms and payment policies. Remedy Apps LLC does not directly issue or handle refunds for in-app purchases.

4. User Content & Ownership

A. Ownership

You retain full ownership of all content, files, and materials that you create, upload, organize, or share through Punch ("User Content"). This includes, but is not limited to, custom data blocks containing:

• Text: Notes, written information, custom fields, and lists.
• Media: Photos, images, and videos.
• Files: Documents, attachments, and stored files.
• Locations: Map pins, saved locations, addresses, and coordinates.
• Links: Web URLs, hyperlinks, and external references.

Remedy Apps LLC does not claim ownership of your User Content.

B. Limited License to Remedy Apps LLC

By creating, uploading, or sharing User Content on or through Punch, you grant Remedy Apps LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, process, transmit, reproduce, and display your User Content solely for the purpose of providing, maintaining, operating, and improving the Service.

C. Content Responsibility, Moderation & Zero Tolerance Policy

You are solely responsible for the User Content you submit. You represent and warrant that you own or have the necessary rights to share your User Content and that sharing it does not violate any third-party rights, privacy rights, or applicable laws.

We maintain a strict zero-tolerance policy for objectionable content, harassment, and abusive behavior. We reserve the right (but have no obligation) to review, flag, filter, modify, or permanently remove any User Content that violates these Terms or is deemed objectionable at our sole discretion.

5. Reporting Objectionable Content & Blocking Abusive Users

To ensure a safe environment on shared visual spaces and boards, Punch provides built-in safety controls:

• Reporting Content:You can report objectionable, harmful, or unauthorized User Content directly within the app by tapping the "Report" button on any shared board, item block, or thread, or by emailing [email protected]. Reported content will be reviewed, and appropriate action (including content removal) will be taken within 24 hours.
• Blocking Users: You have the ability to block any user directly within the app. Blocking a user immediately prevents them from interacting with you, inviting you to shared spaces, or viewing your profile and boards.

We reserve the right to immediately suspend or terminate the account of any user who engages in abusive behavior or posts objectionable content.

6. Prohibited Conduct

You agree not to use Punch to:

• Upload, share, or transmit any content that is illegal, harmful, abusive, harassing, defamatory, vulgar, obscene, pornographic, invasive of another's privacy, or hateful.
• Share unauthorized personal information of third parties without their consent.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the application.
• Upload viruses, malware, or malicious code designed to disrupt, damage, or limit the functionality of any software or hardware.
• Use automated systems (bots, scrapers, crawlers) to access or collect data from the Service.

7. Account Termination & Deletion

A. Termination by Remedy Apps LLC

We reserve the right, at our sole discretion, to suspend or permanently terminate your account and access to Punch at any time, with or without prior notice, for any reason, including but not limited to a breach of these Terms or engagement in prohibited conduct.

B. Termination & Deletion by User

You may terminate your account and request full data removal at any time directly within the Punch app settings screen or by contacting us at [email protected]. Upon deleting your account, your account record, personal credentials, and all associated User Content (including all text, photo, video, file, location, and link blocks) will be permanently purged from our active databases.

8. Intellectual Property Rights

The Punch app, including its logo, brand elements, user interface design, visual assets, code, and trade dress, are owned by or licensed to Remedy Apps LLC and are protected by copyright, trademark, and other intellectual property laws. Except for your User Content, you receive no right, title, or interest in or to the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

REMEDY APPS LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REMEDY APPS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

11. Dispute Resolution & Governing Law

A. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles.

B. Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, or interpretation thereof shall be settled by binding individual arbitration in Georgia, USA. You and Remedy Apps LLC explicitly waive the right to participate as a plaintiff or class member in any class action, collective proceeding, or representative action.
